Question 1

What is the EB-2 National Interest Waiver (NIW)?

Accepted Answer

The EB-2 NIW is an employment-based green card category that allows professionals with advanced degrees or exceptional ability to self-petition for U.S. permanent residency without a job offer or labor certification, provided their work is in the national interest of the United States.

Question 2

Who qualifies for an EB-1A extraordinary ability green card?

Accepted Answer

EB-1A is for individuals who demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim, evidenced by at least three of ten criteria including awards, press, judging, and original contributions.

Question 3

How long does the NIW green card process take?

Accepted Answer

Processing times vary, but the I-140 petition typically takes 6-12 months under regular processing, or 15 business days with premium processing. After I-140 approval, adjustment of status or consular processing adds additional time depending on your priority date.

Question 4

Can I self-petition for an EB-2 NIW without a sponsor?

Accepted Answer

Yes. Unlike most EB-2 categories, the NIW does not require a job offer or employer sponsorship. You can self-petition by demonstrating that your work has substantial merit, national importance, and that you are well positioned to advance that endeavor.

Question 5

What is the difference between EB-1A and EB-2 NIW?

Accepted Answer

EB-1A requires demonstrating extraordinary ability (top of your field), while EB-2 NIW requires an advanced degree or exceptional ability plus proof that your work is in the national interest. Both allow self-petitioning and skipping the labor certification step.
