EB-1A vs EB-2 NIW: which path is right for you?
Both the EB-1A (Extraordinary Ability) and EB-2 NIW (National Interest Waiver) allow self-petitioning — no U.S. employer and no labor certification required. But they are judged against very different bars, and the right choice depends on the strength and shape of your record.
The EB-2 NIW bar
The NIW asks three questions: is your proposed endeavor of substantial merit and national importance; are you well positioned to advance it; and does the waiver, on balance, benefit the United States. The focus is the endeavor and your fit to it — which is why strong researchers and founders who may not be famous still qualify.
The EB-1A bar
EB-1A demands sustained national or international acclaim and that you are among the small percentage at the very top of your field. Operationally, you must document at least 3 of 10 criteria — major awards, membership, publications, judging others' work, original contributions, press coverage, artistic exhibitions, critical roles, high salary, commercial success — and then show the acclaim is genuine, sustained, and recognized by experts outside your own circle.
How to choose
- Clear top-of-field evidence (national awards, major press, leading publications) → EB-1A is the strongest, fastest path.
- Strong but not nationally famous: solid publications, citations, funding, a national-scope venture or project → EB-2 NIW.
- On the borderline → strategists often prepare a preference order (e.g. file EB-1A and fall back to NIW) so one strong petition can be re-framed.
