The EB-2 NIW, explained simply

The Employment-Based Based, Second- Preference (EB-2) visa category is for professionals with an advanced degree or exceptional ability. Normally, this route requires a sponsoring employer and a certified labor certification proving no qualified U.S. worker is available.

The National Interest Waiver (NIW) is the exception. If your work advances the national interest of the United States, USCIS can waive both the job offer and the labor certification — which means you can self-petition. No employer. No labor market test.

Who qualifies

Under current precedent (starting with the N.Y. State Dep’t of Transportation decision), an applicant must prove all three of these:

  1. Their proposed endeavor has substantial merit and national importance;
  2. They are well positioned to advance the endeavor; and
  3. On balance, waiving the job offer and labor certification benefits the United States.

Practically, this means researchers with strong publication and citation records, founders building ventures with national scope, and professionals whose work affects critical sectors, health, or infrastructure — often qualify.

Why petitions fail

NIW petitions rarely fail because the applicant lacks merit. They fail because the evidence is not framed within the three-prong framework. A petition must translate a brilliant CV into a clear legal argument — prong by prong — with objective evidence. That framing is exactly the gap we fill.
